Terms of Service – Digital Products

By purchasing or downloading any digital products from Shane Poole Photography via Pixieset, you agree to the following Terms of Service.

1. Digital Products & Delivery

All products sold are digital downloads unless otherwise stated.

Once your order has been completed and the digital files have been delivered or made available for download, the transaction is considered fulfilled in full.

It is the customer’s responsibility to:

• Download files within the available download period

• Ensure they have suitable devices, storage, and software to access the files

• Back up files once downloaded

We are not responsible for loss of files due to device failure, accidental deletion, or failure to download within the provided time frame.

2. No Refunds on Digital Downloads

Due to the nature of digital products:

All digital downloads are non-refundable and non-exchangeable once delivered.

This includes (but is not limited to):

• Change of mind

• Accidental purchase

• Failure to download files

• Lack of use after download

• Incompatibility with personal devices or software

Once digital files have been sent or accessed, they cannot be returned and no refunds will be issued.

3. Chargebacks & Payment Disputes

By completing a purchase, you acknowledge that:

• Digital delivery constitutes fulfilment of the order

• You waive the right to initiate a chargeback or payment dispute once files have been delivered

In the event of a chargeback, PayPal dispute, or card dispute, we reserve the right to:

• Provide proof of digital delivery, download access, IP logs, and timestamps to the payment processor

• Suspend or revoke access to any digital products associated with the disputed transaction

Fraudulent chargebacks will be disputed fully.

4. Licensing & Usage

All images and digital files remain the copyright of Shane Poole Photography.

Your purchase grants you a personal, non-commercial licence to:

• Download

• View

• Share for personal use

• Print for personal use

You may not:

• Sell, licence, or redistribute the files

• Use images for commercial purposes without written permission

• Remove watermarks from preview images

• Use images in advertising, merchandise, or resale

5. Image Quality & Artistic Style

All images are delivered in the photographer’s professional artistic style.

By purchasing, you acknowledge that:

• Editing style is subjective

• Colour, contrast, and composition are part of the photographer’s creative process

• No re-edits or changes are included unless explicitly stated

6. Technical Issues

If you experience a genuine technical issue accessing your files, please contact us within 7 days of delivery.

We will make reasonable efforts to assist with:

• Download access issues

• Corrupt files caused by delivery errors

This does not override the no-refund policy for digital downloads.

7. Acceptance of Terms

By completing a purchase through Pixieset, you confirm that:

• You have read and understood these Terms of Service

• You agree to all terms listed above

• You accept the no-refund policy for digital products

These Terms apply to all digital purchases, without exception.
